These Website Terms of Use (the "Terms") govern your access to and use of the website www.locationremorquelaval.ca and any related pages, features, tools and online services (collectively, the "Site") operated by Location Remorque Laval (the "Company", "we", "us" or "our"), located at 1870 rue Cunard, Laval, Quebec H7S 2B2. The Company rents trailers, machinery, excavators, lifts and vehicles, sells trailer and RV parts and accessories online, and operates a workshop for mechanical service, repair, maintenance, reinforcement and modification.
These Terms form a binding legal agreement between you and the Company. Please read them carefully. By accessing or using the Site, you confirm that you have read, understood and agreed to be bound by these Terms and by any policies referenced in them. If you do not agree, you must not access or use the Site.
1.1. Acceptance of the Terms
By accessing, browsing, creating an account on or otherwise using the Site in any manner, you accept these Terms and agree to comply with them in full. Your acceptance takes effect as of your first access to the Site and applies to every subsequent visit.
- These Terms apply to all visitors, users, account holders and customers of the Site.
- If you use the Site on behalf of a business, organization or another person, you represent that you are authorized to bind that entity, and "you" then refers to both you and that entity.
- Certain features, purchases, rentals or workshop services may be governed by additional terms, conditions, quotes or contracts (for example, a rental agreement, a sales contract or a workshop work order). Where such additional terms apply, they supplement these Terms; in the event of a conflict for the transaction concerned, the specific terms of that agreement prevail.
These Terms do not reduce, replace or waive any right granted to you by applicable law, including the mandatory protections of the Quebec Consumer Protection Act where it applies.
2.2. Eligibility
The Site is intended for use by persons who have reached the age of majority in Quebec (18 years) and who have the legal capacity to enter into a binding agreement.
- By using the Site, you represent and warrant that you are at least 18 years old and legally capable of contracting.
- If you are under the age of majority, you may use the Site only with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms and who assumes responsibility for your use.
- We may, at our discretion and to the extent permitted by law, refuse access to, suspend or terminate any account or use of the Site where eligibility requirements are not met.
3.3. User Accounts
Some features of the Site may require you to create an account. When you create or use an account, you agree to the following.
- Accurate information. You must provide information that is true, accurate, complete and current, and you must keep it up to date. You are responsible for the consequences of providing inaccurate, outdated or incomplete information.
- Confidentiality of credentials. You are responsible for keeping your username, password and any other access credentials confidential and secure. You must not share your credentials or allow any unauthorized person to use your account.
- Account responsibility. You are responsible for all activity that occurs under your account, whether or not authorized by you, to the extent permitted by law. If you have reason to believe that your account has been compromised or used without your authorization, you must notify us promptly at info@locationremorquelaval.ca.
We may suspend, restrict or close an account, to the extent permitted by law, where we reasonably believe these Terms have been breached, where required to protect the security or integrity of the Site, or where required by law.
4.4. Permitted and Prohibited Use
You may use the Site only for lawful purposes, in accordance with these Terms, and in a manner that does not harm the Company, other users or any third party.
You must not, and must not attempt to:
- scrape, crawl, harvest, index, copy or extract data or content from the Site by any automated means (including bots, spiders, scrapers or data-mining tools) without our prior written authorization;
- breach, probe, test or circumvent the security, authentication or access-control features of the Site, or attempt to gain unauthorized access to any account, system, network or data;
- introduce or transmit any virus, malware, harmful code, or engage in any denial-of-service attack, flooding or activity that disrupts or overloads the Site or its infrastructure;
- use the Site for any fraudulent, deceptive, illegal or unauthorized purpose, or to violate any applicable law or regulation;
- impersonate any person or entity, or misrepresent your affiliation with any person or entity;
- infringe the intellectual property, privacy or other rights of the Company or any third party;
- use the Site to transmit unsolicited communications, spam or advertising; or
- copy, modify, reverse-engineer, decompile, resell or create derivative works from the Site or its software, except as expressly permitted by law.
We may investigate suspected violations and, to the extent permitted by law, take any appropriate action, including restricting or terminating access, removing content and cooperating with law-enforcement or regulatory authorities.
5.5. Intellectual Property
All content on the Site — including text, product descriptions, photographs, images, illustrations, graphics, videos, layouts, designs, page structure, software, code and databases (collectively, the "Content") — as well as all trademarks, trade names, logos and brand elements displayed on the Site, are the property of the Company or of its licensors and are protected by applicable intellectual property laws.
- You are granted a limited, personal, non-exclusive, non-transferable and revocable licence to access and view the Content for your own lawful, non-commercial use of the Site.
- You may not reproduce, copy, distribute, publish, display, transmit, modify, adapt, translate, exploit, or create derivative works from the Content or any trademark or logo, in whole or in part, without our prior written authorization, except where such use is expressly permitted by law.
- Nothing on the Site grants, by implication or otherwise, any licence or right to use any trademark, logo or trade name of the Company or of any third party without our prior written consent or that of the rights holder.
All rights not expressly granted to you are reserved by the Company and its licensors.
6.6. Content Accuracy and Availability
We work to keep the information on the Site accurate and up to date, but we do not guarantee that all Content is complete, current or free of error.
- Prices, stock and specifications may change without notice. Product availability, inventory levels, prices, promotions, descriptions and technical specifications are subject to change at any time and without prior notice.
- Errors. The Site may contain typographical errors, inaccuracies or omissions relating to descriptions, pricing, availability or other information. To the extent permitted by law, we reserve the right to correct any such error and to update information at any time without prior notice.
- Right to refuse or cancel an order. To the extent permitted by law, we reserve the right to limit quantities, refuse or cancel any order, and refuse to provide a rental, sale or workshop service, including where an order was placed based on an evident error in price or description, where we suspect fraud or unauthorized activity, or where an item is unavailable. If we cancel an order for which you have already paid, we will refund the amount paid for the cancelled portion.
Nothing in this section limits your rights under the Quebec Consumer Protection Act, including its rules on advertised prices and price accuracy, which continue to apply.
7.7. Third-Party Links and Services
The Site may contain links to, or integrate, websites, content, tools, payment processors or services operated by third parties ("Third-Party Services").
- Third-Party Services are provided for your convenience only and are not under our control. We do not endorse, and are not responsible for, their content, products, practices, availability or security.
- Your use of any Third-Party Service is at your own risk and is governed by that third party's own terms and privacy policy, which you should review.
- To the extent permitted by law, the Company is not liable for any loss or damage arising from your use of, or reliance on, any Third-Party Service.
8.8. Disclaimer
To the fullest extent permitted by law, the Site and its Content are provided on an "as is" and "as available" basis, without any representation, warranty or condition of any kind, whether express or implied, regarding the Site itself, including as to its availability, continuity, accuracy, reliability, security, or freedom from error or interruption.
- We do not warrant that the Site will be uninterrupted, timely, secure or error-free, or that defects will be corrected.
- We do not warrant that the Site is free of viruses or other harmful components.
This disclaimer applies to your use of the Site itself. It does not apply to, exclude or limit: (a) the legal warranty of quality and durability and any other mandatory warranty applicable to goods sold or services provided under the Quebec Consumer Protection Act and the Civil Code of Québec; or (b) any other right that cannot be excluded or limited by law. Those warranties and rights continue to apply to the products and services you purchase, sell, rent or receive from us.
9.9. Limitation of Liability
To the extent permitted by law, the Company, its directors, officers, employees, representatives and suppliers shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profit, revenue, data, business opportunity or goodwill, arising out of or in connection with your access to or use of, or inability to use, the Site or any Third-Party Service, even if we have been advised of the possibility of such damages.
To the extent permitted by law, our total aggregate liability arising out of or relating to your use of the Site is limited to the amount you paid to the Company, if any, for the specific transaction giving rise to the claim.
Mandatory limits under Quebec law. Nothing in these Terms excludes or limits, and nothing shall be interpreted as excluding or limiting, any liability that cannot be excluded or limited by law. In particular, the Company does not exclude or limit its liability for:
- bodily or moral injury caused to a person;
- gross fault or intentional fault; or
- any breach of the legal warranty of quality and durability or of any other mandatory right or warranty under the Quebec Consumer Protection Act or the Civil Code of Québec.
Where any limitation or exclusion in these Terms is not permitted by applicable law, it applies only to the extent permitted, and your mandatory legal rights remain fully in force.
10.10. Indemnification
To the extent permitted by law, you agree to indemnify, defend and hold harmless the Company and its directors, officers, employees and representatives from and against any claim, demand, loss, liability, damage, cost or expense (including reasonable legal fees) arising out of or connected with:
- your breach of these Terms or of any applicable law;
- your misuse of the Site, including any prohibited use described in Section 4;
- your infringement of the intellectual property or other rights of the Company or any third party; or
- content or information you submit through the Site.
This obligation applies to the extent your fault or breach contributed to the claim, and does not require you to indemnify us for loss caused by our own fault where the law does not permit such indemnification.
11.11. Changes to the Terms
We may modify these Terms at any time, to the extent permitted by law, in order to reflect changes to the Site, our services, our practices or applicable law.
- The revised Terms take effect when posted on the Site, and the "last updated" reference, where shown, indicates the date of the most recent version.
- Your continued use of the Site after the revised Terms are posted constitutes your acceptance of the changes.
- Where a specific transaction (such as a rental, sale or workshop service) is already concluded, it remains governed by the terms in effect at the time it was entered into, unless the law requires otherwise.
We encourage you to review these Terms periodically.
12.12. Governing Law and Forum
These Terms, and any dispute or matter arising out of or relating to them or to your use of the Site, are governed by and interpreted in accordance with the laws in force in the Province of Quebec and the laws of Canada applicable in Quebec, without regard to conflict-of-laws rules.
- Subject to any mandatory right of a consumer under applicable law, you agree that any legal proceeding shall be brought exclusively before the competent courts of the judicial district of Laval, Quebec.
- Nothing in this section deprives a consumer of the right to bring proceedings, or of any procedural protection, granted by the mandatory provisions of Quebec law.
