Limited Warranty and Limitation of Liability

This Limited Warranty and Limitation of Liability (the "Policy") governs the warranties that apply to products sold and services provided by Location Remorque Laval (the "Company"), located at 1870 rue Cunard, Laval, Quebec H7S 2B2. It covers our rental of trailers, machinery, excavators, lifts and vehicles, our online sale of trailer and RV parts and accessories, and the mechanical, repair, maintenance, reinforcement and modification services performed in our workshop.
This Policy is governed by the laws of the Province of Quebec and the applicable laws of Canada. It is provided in English as a courtesy; nothing in it limits, excludes or reduces any right that the law, and in particular the Consumer Protection Act (the "CPA"), grants to consumers. Where any clause could be read as contrary to those mandatory rights, it applies only to the extent permitted by law, and your rights under the law prevail.
1.1. Legal Warranty
Every product we sell and every service we provide is covered by the legal warranty of quality and durability imposed by the Consumer Protection Act and the Civil Code of Quebec. This warranty applies automatically, at no additional cost, and it cannot be excluded, reduced or waived.
Under this legal warranty, a product must:
- be fit for the use for which products of the same kind are ordinarily intended;
- be durable in normal use for a reasonable length of time, having regard to its price, the terms of the contract and the conditions of use;
- be free of latent (hidden) defects that make it unfit for its intended use or that so diminish its usefulness that you would not have bought it, or would not have paid so high a price, had you known of them.
The legal warranty applies in addition to any manufacturer's warranty and to any commercial warranty described in this Policy. Nothing in this Policy limits or replaces the legal warranty. If any statement here appears to conflict with the legal warranty, the legal warranty prevails.
2.2. Manufacturers' Warranties
Many of the trailers, machines, vehicles, parts and accessories we sell or use are covered by a warranty issued directly by the manufacturer. These manufacturers' warranties are passed through to you as-is, on the terms, conditions, durations and limitations set by each manufacturer. The Company does not modify, extend or guarantee the terms of a manufacturer's warranty, which remains the responsibility of the manufacturer.
To make a claim under a manufacturer's warranty:
- contact us first so we can identify the applicable manufacturer, warranty terms and claim procedure;
- keep your invoice, order confirmation or work order, as proof of purchase and date is generally required;
- provide a clear description of the problem and, where relevant, photos, the serial or model number, and the conditions of use;
- where the manufacturer requires it, the product may need to be inspected, returned or presented to an authorized service point.
The Company will reasonably assist you in submitting a manufacturer's warranty claim. This assistance does not make the Company the guarantor of the manufacturer's obligations, and it does not affect the legal warranty described in Section 1, which continues to apply.
3.3. Workshop Labour Warranty
The Company warrants the labour it performs in its workshop — including mechanical work, repairs, maintenance, reinforcement and modifications — against defects in workmanship, for a reasonable period having regard to the nature of the work performed.
If work we performed proves defective within that reasonable period, we will, at our option and to the extent the defect is attributable to our labour, re-perform the work or correct the defect at no charge for our labour, subject to the exclusions below.
This labour warranty does not cover:
- normal wear and tear of parts and components;
- misuse, abuse, negligence, or use of the equipment for purposes for which it is not designed;
- overloading or exceeding rated capacities, speeds or towing limits;
- damage caused by accident, collision, road hazards or external events;
- modifications, repairs, adjustments or maintenance carried out by a third party or by you after our work;
- problems arising from a lack of the maintenance recommended by the manufacturer or by us;
- parts supplied by you or by a third party, which remain covered (if at all) only by their own manufacturer's or seller's warranty.
This labour warranty is in addition to, and does not limit, the legal warranty. Any warranty on parts we install is the manufacturer's warranty on those parts, passed through as described in Section 2, and the legal warranty continues to apply.
4.4. Used or "As Is" Products
The Company may sell used products or products sold on an "as is" basis. For these products:
- the condition of the product is described to you before purchase, including known defects, wear or limitations to the extent we are aware of them;
- you buy the product knowing that it is used and in the condition described;
- the price reflects that condition.
Selling a product as used or "as is" does not remove the applicable legal warranty. Under the Consumer Protection Act, the legal warranty of durability still applies to used products, assessed in light of the product's price, its age, its condition as disclosed, and its normal conditions of use. What you may reasonably expect from a used product is measured against what a reasonable buyer would expect of a product of the same kind, price and condition.
The disclosed condition of the product defines what is considered normal for that product; it does not authorize a hidden defect or a lack of durability beyond what was disclosed and reasonably expected.
5.5. Warranty Exclusions
To the extent permitted by law, the commercial and labour warranties described in this Policy do not cover damage, failure or loss caused by:
- normal wear and tear and the ordinary aging of parts and components;
- misuse, abuse or negligence, or use contrary to the manufacturer's or the Company's instructions;
- overloading or exceeding rated load, towing, weight, speed or capacity limits;
- accident, collision, impact, road hazards, weather events, fire, theft, vandalism or other external causes;
- improper installation, repair or adjustment by a third party or by you;
- a lack of required maintenance, or maintenance not performed according to recommended intervals and procedures;
- unauthorized modifications, alterations or the addition of non-approved parts or accessories.
These exclusions apply only to the commercial and labour warranties. They do not exclude or reduce the legal warranty described in Section 1, nor any other right you hold under the Consumer Protection Act or other applicable law, which continue to apply notwithstanding this Section.
6.6. Limitation of Liability
To the extent permitted by law, and subject to the mandatory limits set out below, the Company's liability in connection with any product sold, service provided, or rental supplied is limited as follows:
- the Company is not liable for indirect, incidental, special or consequential damages, including loss of profit, loss of use, loss of time, business interruption, downtime, towing or immobilization costs, or loss of data;
- the Company's total liability arising out of or relating to a given product or service shall not exceed the amount actually paid to the Company for that product or service.
The following limits are mandatory and prevail over anything in this Section. Nothing in this Policy excludes, limits or reduces:
- the Company's liability for bodily or moral injury caused to a person;
- the Company's liability for its own gross fault or intentional fault;
- your mandatory rights as a consumer under the Consumer Protection Act, including the legal warranty of quality and durability, and any other right that the law does not allow to be waived.
Where any limitation in this Section would be prohibited by applicable law in a particular situation, that limitation does not apply to that situation, and the remaining provisions continue in full force. Your rights under the law remain unaffected.
7.7. Safety Warnings
Trailers, machinery, excavators, lifts, vehicles and their parts can cause serious injury or property damage if they are used, loaded, hitched or maintained incorrectly. For your safety and that of others, you must:
- respect load capacities and never exceed the rated weight, towing, speed or capacity limits of the equipment or of your towing vehicle;
- ensure correct and compliant hitching, including the coupler, safety chains, wiring, brakes and lights, before every use;
- distribute and secure the load properly and verify it before and during transport;
- carry out the maintenance and inspections recommended by the manufacturer and by the Company, and address any defect before use;
- comply with all applicable traffic, transport and safety regulations.
A wrong, incompatible or badly installed part is a safety risk. If you are unsure that a part, accessory or installation is correct and compatible with your equipment and intended use, do not use it and contact us. Following these warnings is your responsibility; failure to do so may cause damage that is not covered by the commercial or labour warranties described in this Policy.
8.8. Governing Law and Jurisdiction
This Policy is governed by and interpreted in accordance with the laws of the Province of Quebec and the applicable laws of Canada. Subject to any mandatory right of a consumer to bring proceedings elsewhere as permitted by law, the parties agree that any dispute relating to this Policy shall be submitted to the courts of the judicial district of Laval, Quebec.
If any provision of this Policy is held to be invalid or unenforceable, that provision shall be limited or severed to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
