Terms of Sale — Parts and Accessories

This document is provided in English for convenience. In case of any discrepancy, the French version prevails.
These Terms of Sale (the "Terms") govern the online purchase of parts and accessories for trailers and recreational vehicles offered by Location Remorque Laval (the "Company," "we," "us" or "our"), located at 1870 rue Cunard, Laval, Quebec H7S 2B2. By placing an order on www.locationremorquelaval.ca, you (the "Customer," "you" or "your") agree to be bound by these Terms.
These Terms apply to online sales of goods only. They do not replace or limit the mandatory rights you hold as a consumer under the Consumer Protection Act (Quebec) and other applicable laws; those rights always prevail over any provision of these Terms that would be less favourable to you.
1.1. Scope and Application
These Terms apply to every order for parts and accessories for trailers and recreational vehicles placed online through our website. They form a binding agreement between you and the Company for each such purchase.
These Terms cover the sale of goods. Rentals of trailers, machinery, excavators, lifts and vehicles, as well as workshop, repair, maintenance, reinforcement and modification services, are governed by separate agreements and conditions and are not covered here.
- Acceptance: By completing an order, you confirm that you have read, understood and accepted these Terms.
- Capacity: You represent that you have the legal capacity to enter into this contract.
- Updates: The Company may amend these Terms at any time. The version in effect at the moment you place your order governs that order.
2.2. Order Placement and Contract Formation
The presentation of products on the website is an invitation to do business and does not constitute a binding offer by the Company. When you submit an order, you are making an offer to purchase the selected products at the price and on the conditions displayed.
A contract of sale is formed only when the Company confirms acceptance of your order, normally by sending an order confirmation by email. An automatic acknowledgement of receipt does not, on its own, constitute acceptance of your offer.
To the extent permitted by law, the Company reserves the right to refuse, limit or cancel any order, in whole or in part, before or after confirmation, including in the following cases:
- Obvious pricing or description error (for example, a price that is manifestly incorrect due to a typographical or technical error);
- Stock shortage or product unavailability;
- Suspected fraud, unauthorized payment, or abnormal or resale-oriented ordering activity;
- Inability to verify the information you provided, or refusal of payment authorization.
If the Company refuses or cancels an order that has already been paid, in whole or in part, you will receive a full refund of the amount paid for the affected products, using the original payment method where reasonably possible. Except for that refund and any mandatory right you may hold under applicable law, refusal or cancellation of an order gives rise to no other liability of the Company.
3.3. Prices
All prices are shown in Canadian dollars (CAD) and, unless expressly stated otherwise, are exclusive of applicable taxes (GST, QST and any other applicable duty or charge), which are added and detailed at checkout.
- Price shown at order time governs: The price applicable to your order is the price displayed for the product at the moment you place the order, subject to Section 2 (obvious pricing error).
- Subject to change: Prices may change at any time without notice. Changes do not affect orders already confirmed by the Company.
- Shipping and delivery charges, where applicable, are indicated separately before you confirm your order, in accordance with our Delivery Policy.
The Company makes reasonable efforts to display accurate prices. In the event of a manifest error, the Company is not required to honour that price and will proceed in accordance with Section 2.
4.4. Payment
Payment is due in full at the time of the order, unless otherwise agreed in writing. The Company accepts the payment methods presented at checkout, which may include major credit cards and other electronic payment options.
- Secure third-party processing: Payments are processed by trusted third-party payment providers. The Company does not store your full card number on its own systems.
- Payment authorization: By submitting payment information, you authorize the charge of the total amount of your order (products, taxes and applicable delivery charges), and you confirm that you are authorized to use the payment method provided.
- Anti-fraud measures: The Company and its payment providers may carry out verification and fraud-prevention checks. An order may be held, delayed or cancelled where payment cannot be authorized or where a transaction is flagged as potentially fraudulent.
No contract of sale is formed and no product is shipped or made available for pickup until payment has been authorized and the order confirmed.
5.5. Availability, Descriptions and Compatibility
The Company takes care to describe its products accurately. Photographs, illustrations, specifications and descriptions are provided for information purposes; minor variations in appearance or specification may occur, and product availability is not guaranteed until your order is confirmed.
Compatibility is your responsibility. Parts and accessories for trailers and recreational vehicles must match your specific vehicle, model, year and configuration. Before ordering, you are responsible for verifying that the product is compatible with your equipment and suitable for your intended use.
- The Company may provide advice or guidance on compatibility as a courtesy, but such advice does not replace your own verification and does not constitute a guarantee of fit.
- We strongly recommend that you validate compatibility with the manufacturer's specifications, or with a qualified professional, before purchasing or installing a product.
- Special orders (products ordered or sourced specifically at your request, and non-stocked items) are final sale and non-cancellable once the order is confirmed, to the extent permitted by law.
Nothing in this Section limits your mandatory rights under the Consumer Protection Act, including the right to a product that conforms to its description and is fit for the purposes for which goods of that kind are ordinarily used.
6.6. Delivery and Transfer of Risk
Delivery is offered across Quebec, with free delivery on eligible orders over $300, or pickup at our Laval location. Delivery times, methods, charges and conditions are described in our Delivery Policy, which forms part of these Terms.
- Estimated timelines: Delivery dates are estimates and are not guaranteed unless expressly agreed in writing.
- Transfer of risk: To the extent permitted by law, the risk of loss of or damage to the products passes to you upon receipt of the products by you (or by a person you designate) for delivered orders, or upon pickup for orders collected in Laval.
- Inspection: We recommend that you inspect the products upon receipt or pickup and report any visible damage or discrepancy promptly.

7.7. Transfer of Title
Ownership (title) of the products passes to you only upon full payment of the total price of the order, including products, applicable taxes and delivery charges.
Until full payment has been received, the products remain the property of the Company. The transfer of title is distinct from the transfer of risk described in Section 6, which occurs upon receipt or pickup.
8.8. Warranty
Your purchases are covered by the legal warranty of quality and durability provided under the Consumer Protection Act (Quebec) and the Civil Code of Québec. Under this warranty, the goods must be fit for the use for which they are ordinarily intended and must be durable in normal use for a reasonable length of time, having regard to their price, the terms of the contract and the conditions of use. This legal warranty applies free of charge and cannot be waived or reduced.
- Manufacturers' warranties: Many products also carry a warranty offered by their manufacturer. Such warranties are provided by the manufacturer, on its own terms, and are in addition to the legal warranty.
- How to claim: To make a claim, contact us using the details in Section 12 with your order information and a description of the issue.

9.9. Returns
Returns and exchanges are governed by our Returns Policy, which forms part of these Terms and sets out eligibility conditions, timelines, the condition in which products must be returned, and any exclusions (including special-order and final-sale items referred to in Section 5).
The Returns Policy applies in addition to, and does not limit, your mandatory rights under the Consumer Protection Act. Please consult the Returns Policy before initiating a return.
10.10. Liability
To the extent permitted by law, the Company's liability in connection with the sale of a product is limited to the amount you paid for that product, and the Company is not liable for indirect, incidental or consequential damages arising from the use of a product.
These limitations apply only to the extent permitted by law. They do not, and are not intended to, exclude or limit the Company's liability where such exclusion or limitation is prohibited. In particular, and without limitation, the Company does not exclude or limit its liability for:
- Bodily or moral injury;
- Gross fault or intentional fault;
- Any obligation under the legal warranty of quality and durability and other mandatory rights guaranteed by the Consumer Protection Act and applicable law.
Installation: Parts and accessories must be installed correctly and used in accordance with their instructions and intended purpose. Installation, modification or use of a product by an unqualified third party, or contrary to the manufacturer's instructions, may affect or void certain manufacturer warranties and may create risks for which the Company cannot be held responsible, to the extent permitted by law. Your mandatory rights under the Consumer Protection Act remain unaffected.
11.11. Governing Law and Jurisdiction
These Terms and any contract of sale formed under them are governed by and interpreted in accordance with the laws of the Province of Quebec and the laws of Canada applicable therein.
Subject to any mandatory right you may have under the Consumer Protection Act, any dispute relating to these Terms or to a purchase shall be submitted to the exclusive jurisdiction of the competent courts of the judicial district of Laval, Province of Quebec.
